San Francisco Criminal DUI Court ProceedingsIf you were charged with a DUI in San Francisco, you were found to be impaired while driving and your BAC (blood alcohol concentration) was 0.08% or higher. Being impaired while driving means "The inability to operate a motor vehicle with the caution, attention, and alertness that one would typically exercise if sober." Separate from your DMV hearing, you will face these criminal charges in court. Here, you have the right to a jury trial and the right to have an attorney represent you. The prosecutor must prove beyond a reasonable doubt that you are guilty of the following: "driving a vehicle while under the influence or in violation of the per se laws" (driving with a BAC of 0.08% or higher). Charges against you will be dropped if there is any reasonable doubt. If, however, the prosecution was able to prove beyond a reasonable doubt that you were guilty, you will be faced with serious punishments. These are, but are not limited to: a suspended license (even if the DMV did not suspend your license), probation, attendance in alcohol-related classes, hefty fines, jail time, and possible installation of an ignition interlock device on your vehicle. Prior DUI convictions, reckless driving, accident resulting in injury or death, minor passenger, refusal to take chemical testing, and a BAC of 0.15% or higher will significantly increase your punishments.
